What is DWI Education Program?

When you meet with your lawyer for the first time after being charged with Driving While Intoxicated or similar offenses (DWI 2nd, Felony DWI, Driving Under the Influence of Drugs, Intoxication Assault, etc.) they will discuss things you can proactively do to help your case even before you step foot in a courtroom. One of those proactive things is attending a DWI Education Class. Attending a DWI class through a Texas DWI education program before your court hearing is in no way an admission of guilt, but merely an acknowledgment back of the situation you’ve been placed in, and can help you by showing the prosecutor in charge of your case that you’re ready to do what it takes to put it all behind you. If your case qualifies for the Tarrant County Misdemeanor DWI Court Program, you will be required to complete several therapeutic rehabilitative activities and courses. Even if you don’t complete one of these classes pre-conviction, you will be ordered by the court to sign up for one of these courses within five days of your conviction for DWI. Completing a DWI Education Class is mandatory according to Texas Code of Criminal Procedure 42A.403, and must be completed within the first 180 days of community supervision. These 12-hour classes are held regularly throughout the DFW area and are designed to equip drivers with tools and information to reduce the probability of further DWI behavior.

EDUCATIONAL PROGRAM FOR CERTAIN INTOXICATION OFFENDERS…
(a) A judge who places on community supervision a defendant convicted of an offense under Sections 49.04-49.08, Penal Code [Driving While Intoxicated; Driving While Intoxicated with Child Passenger; Flying While Intoxicated; Boating While Intoxicated; Assembling or Operating an Amusement Ride While Intoxicated; Intoxication Assault; Intoxication Manslaughter], shall require as a condition of community supervision that the defendant attend and successfully complete, before the 181st day after the date community supervision is granted, an educational program designed to rehabilitate persons who have driven while intoxicated that is jointly approved by:

(1) the Texas Department of Licensing and Regulation;
(2) the Department of Public Safety;
(3) the traffic safety section of the traffic operations division of the Texas Department of Transportation; and
(4) the community justice assistance division of the Texas Department of Criminal Justice.

DWI Victim Impact Panel (VIP)

Victim Impact Panels are designed and organized by the national organization Mothers Against Drunk Driving (MADD). In addition to traditional criminal sanctions (jail time, fines, education courses), a person convicted of Driving While Intoxicated or other forms of distracted driving might be required to attend an in-person Victim Impact Panel (VIP). During one of these panels you might hear from victims or family members of drunk or drugged driving, first responders or substance abuse/treatment representatives. If you are required to attend a DWI/DUI Victim Impact Panel presentation you should pre-register and pre-pay online, bring a photo ID and attend the meeting in person, arriving 30 minutes early. If you wish you want to pay when you arrive at the VIP you will need a money order – payable to MADD. To improve the chance of a favorable outcome, attending and completing alcohol awareness classes are critical.
