Our client was wrongfully accused of Capital Murder of a Child. After an eight-day jury trial in the 371st District Court in Tarrant County, on Wednesday, March 12, 2025, the jury found our client Not Guilty of all counts, including Capital Murder of a Person Under 10 Years Old, Felony Murder, and Injury to a Child. The Tarrant County case number was 1825717, but the case record will soon be expunged.

If the jury convicted our client, then he would have faced a sentence of Life in Prison without Parole – punishment for Capital Murder prescribed in a Texas statute when the state has waived the death penalty. Instead, our client went home to his family after trial.

Under Texas Penal Code Section 19.03, a person commits Capital Murder if the person commits Murder as defined under Section 19.02(b)(1) and the person murders an individual under 10 years of age. Pursuant to Section 12.31 of the Penal Code, if someone is found guilty of a “capital felony” in which the State does not seek the death penalty, then the person shall be punished by imprisonment in the Texas Department of Criminal Justice for Life Without Parole.
