Brief Explanation
Originally, our client was facing a 10-year minimum (up to Life) in prison for Conspiracy to Distribute a Controlled Substance. Based upon Cody Cofer’s questioning at the Detention Hearing and a close review of evidence, we convinced the Assistant United States Attorney to allow our client to plead to a “Phone Count” with a four-year maximum. Even with the lesser charge, the resulting Guideline imprisonment range was 84 months to 105 months. However, the judge could only impose a 48-month sentence.
